I refer to the Engineer's Representative (HMJV)’s letter (reference: KL/2014/03/M45/100/7282 dated 12 March 2021 submitting the updated Landscape Mitigation Plan for the captioned Contract under Condition 2.11 of the Environmental Permit No. EP-337/2009 and Condition 2.5 of Environmental Permit No, EP-451/2013.

 

Having reviewed the submission and consulted the Director of Planning, we consider the submission has not yet complied with the captioned EP conditions. Our comments· on the submission are enclosed in Annex I for your follow up.

 

 

General Comments

 

1.

It is understood that the submission covers part of Road D4 which should be covered by Permit No. EP-337/2009 (Register No. AEIAR-130/2009) and a small portion of Trunk Road T2 which should be covered by Permit No. EP-451/2013 (Register No. AEIAR-174/2013). The extent of the corresponding EP covered area should be clearly indicated on plan for reference.

 

 

Please find the extent of the works for part of Road D4, covered under Permit No. EP-337/2009 (Register No. AEIAR-130/2009) and construction of a small portion of Trunk Road T2 (Supporting Underground Structure), covered under Permit No. EP-451/2013 (Register No. AEIAR-174/2013) marked on plans in Appendix A - Figures A1 and A2.

The submission has not yet complied with Condition 2.11 of EP-337/2009 and Condition 2.5 of EP-451/2013, since there is insufficient information to demonstrate conforming to the mitigations contained in the approved EIA Reports (Register No. AEIAR-130/2009 and AEIAR-174/2013). Information and consideration related the concerned EP conditions should be reflected / elaborated by relevant landscape drawings in the submission. As per our previous comments to other portion of Kai Tak Development (KTD), The Environmental Team Leader (ET) and Independent Environmental Checker (IEC) should critically review the contents before formal submission. The IEC and ET are reminded to duly exercise their duties in accordance to EP Condition 1.9 of the EPs.

Noted. The description of all the measures are provided under Section 3 of the plan. The measures addressing Condition 2.11 of EP-337/2009 is addressed in Table 3.2 while Condition 2.5 of EP-451/2013 is addressed in Table 3.3 of the submission. Relevant landscape drawings are supplemented with annotation showing mitigation measures adopted.

The Permit Holder should arrange the LMPs to relate to / compare with the corresponding AEIARs, i.e. Figure 13.6 and Figure 13.6.2 of AEIAR-130/2009 and Figure 9.11.2 of AEIAR-174/2013, etc.

The comparison with the corresponding AEIARs are shown in Appendix A - Figures A10 and A11.

The currently submitted LMPs in A4 is small and unclear. LMPs should be presented in suitable scale with blow up plans, sections and typical details where appropriate. Respective Landscape Mitigation Measures (LMMs) should be annotated on all relevant drawings to demonstrate the provisions of landscape mitigation measures and the effectiveness of planting proposal for alleviation of impacts.

Please find the attached LMPs in A3 size with blow up plans, section and typical details for your information. LMMs are also annotated on relevant drawings as shown in Appendices A to F.

5.

Tables 3.2 and 3.4: To serve as an implementation schedule of mitigation measures recommended in the submission, please include columns stating the location (by referring to relevant drawing), implementation party, maintenance party and implementation timing of the respective mitigation measures.

Noted. The schedule of mitigation measures is revised as shown in Tables 3.2 and 3.3.

 

Specific comments for Condition 2.11 of Environmental Permit No. EP-337/2009:

 

 

CM1 – All existing trees should be carefully protected during construction

Tree protection plan is missing.

Please find the blow up of tree protection plan as shown in Appendix B Figures B1 to B2.

As indicated in Table 3.2 "Summary Table of Landscape and Visual Mitigation Measure's implemented in accordance with the Landscape Mitigation Plan deposited under Condition 2.11 of EP-337/2009", 117 trees will be compensated. However, only 109 nos. of trees will be planted as indicated in Dwg. 6002240S/SK/1700 - Planting Schedule of Appendix A, and as illustrated in Dwg. 6022408/SK/1701-1703 - Tree Planting Plan, total 112 nos. of new trees is shown on plan. Inconsistencies of information should be rectified.

Please be clarified that the 109 numbers of trees will be compensated. The report and corresponding drawing no.60022408/SK/1703 have been revised accordingly in Appendix A - Figure A5.

 

CM2 - Tree unavoidably affected by the works should be transplanted where practical

The Permit Holder should clarify whether there is any proposed transplant trees within

the concerned extent of works and submit relevant information for review.

Please be clarified that no tree would be transplanted in the concerned area under this report.

 

OM1 - Compensatory tree planting should be incorporated into the proposed projects where trees are affected:

 

 

OM2 - Tall buffer screen tree/ shrub/climber planting, vertical green and roof greening where appropriate should he incorporated to soften hard engineering structures and facilities;

When compared with Fig. 13.6.3 of AEIAR-130/2009, tree and shrub planting in the central median is not observed. Justification for possible design change and alternative landscape treatment, where appropriate, should be presented in the submission. Besides, the updated no. of new tree planting should be clearly indicated in the submission.

Please be clarified that shrub would be provided in the central median at Road D4. Due to the space limitation of central median at Shing Cheong Road, Cheung Yip Street and Kai Tak Bridge Road, no tree would be provided in the central median of the concerned area. For the latest tree planting plan of Shing Cheong Road, Cheung Yip Street and Kai Tak Bridge Road, please find the attached Appendix A - Figure A3 to A5 for your information.

 

10.

Typical details showing the minimum clear soil depth with proper drainage for different types of plantings should also be provided to demonstrate the sustainability of planting.

Please refer to the typical details of minimum clear soil depth and drainage at planter are shown in Appendix A - Figure A12.

 

OM5 -Aesthetically pleasing design as regard to the form, material and finishes shall be. incorporated to all buildings. engineering structures and associated infrastructure facilities

The Permit Holder should clarify if there is any building, engineering structure and associate facility for this EP submission. If affirmative, it is advised to provide a list of the above ground buildings/ structures associated infrastructure facilities and the corresponding aesthetic consideration, such as proposed materials, finishes, colours etc., preferably presented in table for clarity.

Please be clarified that there is no building, engineering structure and associate facility for Road D4 (part) in this submission under EP no. EP-337/2009.

 

Specific comments for Condition 2.5 of Environmental Permit No. EP-451/2013

It is noted that a separate submission of Landscape Mitigation Plan for Trunk Road T2 (whole section) under EP condition 2.5 of EP-451/2013 was submitted by other party and our pervious comments on the concerned EP submission should generally be applicable for the whole project Trunk Road T2.

Noted. As Contract No. KL/2014/03 only covers small portion of Trunk Road T2 (Supporting Underground Structure), and the landscape works for Trunk Road T2 would be covered under Contract No. ED/2018/04. Thus comments in OM1, OM2, OM3 and OM5 given in letter ref. () in EP2/K2/A/21 pt.7 dated 6 July 2020 related to landscape works of Trunk Road T2 would be covered under Contract No. ED/2018/04.

For the current EP submission. no clear extent and supporting information for the part of Trunk Road T2 is indicated. The extent of work covering by this EP should be clearly indicated on plans with supporting information for our further review.

The extent of works covering by this EP submission is shown in Appendix A - Figures A1 and A2 for your information.

Table 3.4 "Summary Table of Landscape and Visual Mitigation Measures adopted in the Landscape Mitigation Plan according to Condition 2.5 of EP-451/2013", majority of the information is not related to this EP covering but simply duplicated with those presented for area under EP-337/2009. Revision of this section should be carried out.

 

 

 

 

Noted. Since this report only covers part of Trunk Road T2 (i.e. Supporting Underground Structure under Contract No. KL/2014/03), the Landscape Mitigation Plan covering Trunk Road T2 (whole section) will be submitted separately under Contract No. ED/2018/04 for EP no. EP-451/2013.

 

Advisory comment for improvement

 

15.

As per our previous comment for other parts of Distributor Roads for KTD. it is noted that the captioned submission is for part of Road D4 only. while other portions of the Distributor Roads should be submitted for comments once available, or as-built drawings were already submitted for some parts of Distributor Roads (e.g. Road D1 and D2 etc.). For easy reference and proper record. the Permit Holder is advised to indicate the currently submitted portion of work together with the tentative status of other portions on a key plan.

Please find the summary of status for Road D1 to Road D4 in the Appendix A Figure A13 for your information.

The Permit Holder is also reminded that comments on this portion of works should generally be applicable to the remaining portions for ‘DP1-Distributor Roads".

For any proposed tree preservation / removal application including compensatory proposal. the Permit Holder shall be reminded to approach relevant authority / government department(s) direct to obtain any necessary approval.

1.                 Introduction

This plan presents a landscape and visual impact assessment and mitigation measures during construction and operational phase of this project, Contract no. KL/2014/03 Kai Tak Development – Stage 3 Infrastructure Works for Developments at the Southern Part of the Former Runway, and the Works to be executed under this Contract include the following major items:

a)         Construction of approximately 420m long supporting underground structure (SUS) including diaphragm walls, barrettes, top and bottom slabs, end walls and adits underneath Shing Cheong Road and Cheung Yip Street;

b)        Widening and re-alignment of Cheung Yip Street of approximately 330m long and associated footpaths;

c)         Demolition, reconstruction and widening of Shing Cheong Road of approximately 410m long and associated footpaths;

d)        Construction of drainage outfall and modification of existing seawall;

e)         Demolition of existing RADAR Tower and guard house;

f)         Construction of two subways between Phase II of New Acute Hospital (Site A) and Hong Kong Children’s Hospital (Site C), and between Phase I of New Acute Hospital (Site B) and Site C;

g)        Construction of District Cooling System (DCS) along Cheung Yip Street and Shing Cheong Road;

h)         Construction of ancillary works including surface drainage, sewerage, water, fire-fighting, street lighting, street furniture, road marking, road signage, utilities and services, irrigation and landscape works; and

i)          Other Works which are shown on the Drawings or Specifications or which may be ordered in accordance with the Conditions of Contract.

The works extent of Road D4 (part) and Trunk Road T2 (part) under Contract No. KL/2014/03 are demonstrated in Figure A1 and Figure A2. It covers the landscape and visual impact assessment and mitigation measures for the construction and operation of distributor road Road D4 (part) under EP-337/2009 and a supporting underground structure of about 0.4 km long under EP-451/2013. The status of Landscape Mitigation Plan and as-built drawing submission for EP-337/2009 is summarized in Figure A13.

2.                 Objective

With reference to EP-451/2013 Part C section 2.5 and EP-337/2009 Part C Section 2.11, a Landscape Mitigation Plan is required to be submitted to the director of EPD. The Plan is to identify the landscape and visual impacts rise during the construction and operation phases of this project, and to ensure that proposed landscape and visual impact mitigation measures are effectively implemented according to the EM&A requirements.

The Landscape Mitigation Plan under EP-451/2013 (Trunk Road T2) shall include, but not limited to, the design of the tunnel portals and all above ground structures to ensure that the elements with color, texture and tonal quality are compatible to the existing urban context. Also trees and shrub planting to minimize the potential adverse landscape and visual impacts shall be included where space permits. Roof top greening and vertical greening plan shall also be provided.

The Landscape Mitigation Plan under EP-337/2009 (Distributor Road Road D4) shall include, a) Compensatory tree planting shall be incorporated into the Project where trees are affected. b) Tall buffer screen tree/shrub/climber planting shall be incorporated to soften hard engineering structures and facilities. c) Sensitive streetscape design shall be incorporated along the new roads to reflect the new urban development at Kai Tak. d) Structure, ornamental tree/shrub/climber planting shall be provided along roadside amenity strips and central dividers to enhance the townscape quality, where space is available. e) Aesthetically pleasing design as regard to the form, material and finishes shall be incorporated to all buildings, engineering structures and associated infrastructure facilities.

3.                 Mitigation Measures

3.1            Proposed Design Measures for the Distributor Road Road D4 and Trunk Road T2 (part)

As the majority of trunk road T2 will be in tunnel, landscape and visual design will be concentrated on tunnel portals and three buildings at the western end, namely the Ventilation and Tunnel Portal Buildings. The solely design measure incorporated in layout and design of the trunk road T2 relevant to this project is –

l   Provide depression and tunneling of roads in order to reduce the visual impact and improve the landscape quality of the environment at ground level.

The distributor road Road D4 form part of the KTD and their alignments are formulated under the development and urban design frameworks for KTD. Proposed Design Measures incorporated in layout and design of the distributor road is described below.

Aesthetic Pleasing Design of Roads and Streetscapes

Roads and Streetscapes are potentially significant detractors to both the landscape and visual amenity of KTD. In order to minimize the impacts which they may cause, a series of measures have been incorporated in the development layout. These include:

·               Creation of a pleasant pedestrian environment with sympathetic landscape treatments for the road networks within the site,

·               Provision of road side planting, in particular trees, along all new distributor and local road where possible and practicable,

·               Minimization the extent of utility reserves within pavement,

 

Provision of Compensatory Planting

As new planters will be constructed along the new distributor road Road D4, it will provide opportunity for the compensation to the loss of any planting disturbed by the works. 109 trees will be planted for distributor road Road D4 in accordance with the planting schedule.

At Shing Cheong Road and Kai Tak Bridge Road, various types of trees and shrub, ornament lightings were proposed along the roadside amenity strips to enhance the townscape quality. However, tree would not be provided along the central divider due to the high maintenance cost as stipulated in Chapter 4 of Street Tree Selection Guide. The reason is discussed in Appendix A Figure A3.

At Cheung Yip Street, as New Acute Hospital (NAH) project team proposed to construct a right turn opening at central median at Cheung Yip Street, the central divider with trees, shrub, and ornament lighting was replaced by hard landscape with paving blocks. And granite paving block with colour variation would be adopted to enhance the visual quality of the Cul-de-Sac. The reason is discussed in Appendix A Figure A4.

 

For the comparison for the abovementioned amendment, please refer to Appendix A Figures A9 and A10.

The compensatory tree planting is out the scope of works of Contract No. KL/2014/03. The detailed compensatory tree planting plan of Trunk Road T2 would be submitted by separated submission under Contract No. ED/2018/04.

Compensatory tree planting shall be incorporated by the project. The required numbers of compensatory trees shall the requirements of ETWB TCW No. 3/2006. Loss of amenity area adjacent to the Kwun Tong By-pass and planting areas in KTD South Apron will be mitigated by the creation of the Kai Tak South Apron: Amenity Area, which will be equal to or larger than the current provision.

The compensatory tree planting creation of the Kai Tak Apron (Amenity Area) is outside the scope of works of Contract No. KL/2014/03. The details of compensatory tree planting and creation of Kai Tak Apron would be submitted by separated submission under Contract No. ED/2018/04.

Trees, shrubs and climbers shall be planted to soften and screen proposed roads, central medians and associated structures, and to enhance streetscape greening.

None of trees, shrubs and climbers would be planted in the supporting underground structure under Contract No. KL/2014/03. The trees, shrub and climbers plan would be submitted by separated submission under Contract No. ED/2018/04.

All works areas, excavated areas and disturbed areas for tunnel construction and temporary road diversion or any other proposed works shall be reinstated to former conditions or better, with landscape treatment and to the satisfaction of the relevant Government department.

Tunnel portals and all above ground structures shall be sensitively designed to ensure the element with colour, texture and tonal quality being compatible to the existing urban context. Trees and shrub planting to minimize the potential adverse landscape and visual impacts shall be included where space permits. Roof top greening and vertical greening shall also be provided.

The construction of tunnel portals is outside the scope of Contract No. KL/2014/03. The design of tunnel portals and above ground structures would be submitted by separated submission under Contract No. ED/2018/04.
